The problem

Since August 2, Article 50 requires providers to make synthetic outputs machine-detectable and deployers to disclose AI-generated or manipulated image, audio and video when it qualifies as a deep fake.

or 3 % of worldwide turnover is the upper penalty tier that can apply to an undertaking for non-compliance with Article 50; special lower-cap rules apply to SMEs. A missing internal production log is not itself the offence, but a clear record makes disclosure decisions, approvals and delivery evidence far easier to answer later.

The requirements

What clients already require.

Broadcasters, platforms and rights offices already spell out what the law means in practice:

  • The German agency association GWA, on agencies using AI tools: your co-responsibility covers “the labelling obligation and the documentation of use.” GWA KI-Whitepaper 2025

  • Netflix expects production partners to “share any intended use of GenAI”, and for final deliverables “written approval will be required before you proceed.” Netflix Partner Help Center

  • The US Copyright Office: registering work with AI in it comes with a “duty to disclose” the AI-generated parts and to describe what the human contributed. US Copyright Office

A defensible production record answers the questions the final file cannot: which parts used AI, which tool, prompt and references were involved, what a human changed, which version was approved and how the published work was disclosed. BTW keeps that context with the shot while the team works.
